The Supreme Court of Justice of the Nation in Mexico unanimously upheld the constitutionality of restrictions on the sale of unhealthy food and beverages in all educational institutions on October 13 2026.[1] The ruling validates guidelines that set nutritional criteria for the preparation, distribution and sale of processed and bulk food and beverages across the entire National Educational System.[2] This includes preparatory schools and universities.[3] The court found the General Education Law authorizes educational and health authorities to regulate food sales within schools. It concluded the challenged guidelines do not exceed legal powers granted to those authorities.[4] Ministers acknowledged university students hold freedom to choose what foods they consume. They ruled the state retains an obligation to protect the right to health and promote adequate nutrition within educational premises.[5] The court also held the measures do not violate freedom of commerce. Restrictions apply to products failing nutritional criteria, including items carrying warning labels for excess sugars, sodium, saturated fats or calories.[6] The underlying regulations were first published in September 2024. They establish mandatory nutritional standards intended to end sale of low nutritional value food in schools.[7] The resolution supports consistent state implementation of the food rules across educational institutions.[8]
